TERMS & CONDITIONS

1. General Terms

By commissioning any photographic assignment, the client agrees to these Terms & Conditions.

The Photographer, JULES VAN ENGERS, grants the client a non-exclusive, non-transferable license to use the final images for:

  • Brand website

  • Social media channels

  • Online press

  • Digital marketing and promotional purposes

This “BASIC” license includes indefinite duration and unlimited online use, unless otherwise agreed.

2. Attribution

Images used online must include one of the following credits:

  • Jules van Engers

  • @julesvanengers

  • www.julesvanengers.com

For commercial use without attribution, a paid usage license or buy-out is required.

3. Excluded Uses (Require Additional Licensing)

The following usage categories are not included in the standard license and require a separate agreement:

  • National or international advertising campaigns

  • Out-of-home advertising (billboards, bus shelters, metro, etc.)

  • TV or online commercials

  • Print advertisements

  • Books, magazines, catalogues, or large-scale printed media

Such uses are considered new usage and require a tailored licensing quote.

4. Copyright & Ownership

All images remain the copyright and intellectual property of JULES VAN ENGERS. The client purchases usage rights, not ownership.

The following are not permitted without written permission:

  • AI model training or synthetic image generation

  • Resale or sublicensing of images

Copyright buy-outs require a custom quote.

5. Shooting & Editing Guidelines

5.1 Shooting & Retouching

  • Shooting and retouching follow a 1:1 hourly ratio, billed at the same rate.

  • Images are delivered in 72dpi for web and social media unless otherwise requested.

  • Image format/orientation must be agreed before the shoot.

  • RAW files are not included unless pre-arranged (see RAW clause).

5.2 Selection & Revisions

  • The client receives a selection gallery to choose preferred images.

  • One round of editing revisions is included.

  • Additional revisions are billed at the standard retouching rate.

  • Client may request the Photographer to handle image selection.

5.3 Editing Restrictions

The client may not:

  • Apply filters

  • Re-edit or recolor images

  • Crop or alter the composition

Edits must remain consistent with the Photographer’s style.

6. Photographer Usage

The Photographer may use images for her portfolio, website, social media, and promotional materials unless agreed otherwise in writing.

7. Delivery & Archiving

  • Standard delivery time is 30 working days.

  • Delays caused by late client feedback extend the timeline.

  • Images are archived for 3 months; extended storage is available upon request.

8. Payment Terms

  • All prices are excl. 21% VAT (NL).

  • Event Photography: payable within 30 days.

  • Fashion/Branding/Commercial Photography: payable within 5 working days.

  • Retouching Fees: payable within 5 working days of image delivery.

  • Retouching begins after the Photography Fee is paid.

Late Payments

Late payments may incur:

  • Monthly interest fee of 2%

  • Administrative fee of € 25 per reminder

9. Cancellation

  • Cancellation must be submitted via email.

  • Cancellation 48 hours before the assignment: 50% of the quoted fee.

  • Cancellation within 24 hours: 100% of the quoted fee.

  • Rescheduling is treated as cancellation unless otherwise agreed.

  • Deposits (if applicable) are non-refundable.

10. Commercial Usage & Buy-Outs

A usage license or buy-out may be requested. Pricing is based on:

  1. Duration of use (days/months/years)

  2. Platforms (online, OOH, print, POS, etc.)

  3. Campaign type

  4. Number of final images

License Rules

  • Licenses cannot be resold or transferred.

  • Unauthorized usage results in a penalty of 3× the normal rate (minimum €185 excl. VAT).

  • Standard licensing covers global online use unless specified otherwise.

11. RAW File Policy

RAW files are never supplied unless agreed beforehand. If RAW licensing is approved:

  • A 200% surcharge of the day rate applies.

  • Only a curated selection of RAW files is provided.

  • No guarantee is given for software compatibility.

  • Editing RAW files must respect copyright.

12. Liability

The Photographer is not liable for:

  • Technical malfunctions

  • Weather disruptions

  • Force majeure events

  • Delays caused by the client

  • Missing model/property/product permissions

The client is responsible for all required permits and releases.

13. Final Provisions

These Terms & Conditions apply to all commissioned work unless amended in writing and approved by both parties.
